Yes. We have acted for employers and employees on all types of disputes which touch upon the employment relationship.

This ranges from disputes during the employment relationship (such as issues over conduct, performance, internal/external investigation and bonus/deferred compensation payments) through to termination and post termination, where the dispute may relate to the termination itself, terminal payments/ separation agreements or restriction on the employee’s activities such as use of confidential information and joining a competitor.

We have extensive experience in all stages of litigation; including commencing claims and complaints at the Labour Tribunal and the Equal Opportunities Commission and representing clients at all levels of the Court system – from the High Court to the Court of Final Appeal.

Yes. We have substantial experience in this area and are often instructed on high profile and complex matters relating to individual/team moving to a competitor, soliciting clients and poaching employees as well as retention and misuse of confidential information.

We adopt a practical approach when disputes arise ensuring that businesses have the best strategy in place to minimise risk and threat when an individual (or team) leaves. We also advise individuals on how best to defend litigation and injunction applications relating to their conduct.

We advise on both contentious (disputes) and non-contentious matters. Aside from the matters we described above, we also have significant experience in advising on performance reviews and appraisals, disciplinary issues, discrimination/harassment complaints and redundancy issues.

On the non-contentious side, we regularly advise on hiring strategies, negotiating and drafting contract terms and handbooks, issues relating to Personal Data (Privacy) Ordinance and advise on termination and separation agreements.
