Frequently asked questions

Arbitration is a form of alternative dispute resolution (ADR) that seeks to resolve disputes outside the courts as agreed by the parties. An unbiased third person or third parties, the arbitrators, decide the dispute and render the arbitration award. The award is final, legally binding and enforceable.

Arbitration is often used for the resolution of commercial disputes. It is particularly effective in international transactions.

In principle, arbitrations should be faster (hence, more costs-efficient) and more flexible in terms of rules and procedures. Unlike litigation, arbitration can be entirely disposed on the papers.

There is no appeal against an arbitral award, but you may seek legal advice as to the prospect of setting aside an arbitral award based on local laws.

Individuals may choose Hong Kong as an arbitration seat for their dispute so they can rely on a world class framework, independent and neutral forum, and an arbitration friendly judiciary.  As an international financial centre, Hong Kong harbours the most sophisticated commercial disputes in the world, and hence nurtures and attracts top legal talent.  It is also the first and only jurisdiction which the Mainland Chinese Courts would grant ancillary interim measures in aid of the arbitrations seated there.
