\u66f4\u65b0\u7684\u4e3b\u8981\u91cd\u70b9\u662f\uff1a<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>\u81ea\u300a\u5b89\u6392\u300b\u751f\u6548\u4ee5\u6765\u81f32019\u5e7412\u6708\u4e2d\u65ec\uff0c\u9999\u6e2f\u56fd\u9645\u4ef2\u88c1\u4e2d\u5fc3\u5df2\u6536\u5230<strong>\u5341\u4e00<\/strong>\u4efd\u5173\u4e8e\u6839\u636e\u300a\u5b89\u6392\u300b\u6388\u4e88\u540c\u610f\u4e66\u7684\u7533\u8bf7\u3002<\/li>\n\n\n\n<li>\u8fd9\u5341\u4e00\u4efd\u7533\u8bf7\u90fd\u51fa\u81ea\u9999\u6e2f\u56fd\u9645\u4ef2\u88c1\u4e2d\u5fc3\u4ef2\u88c1\u89c4\u5219\u7ba1\u8f96\u4e0b\u7684\u5f85\u51b3\u4ef2\u88c1\u3002<\/li>\n\n\n\n<li>\u5176\u4e2d\u6709\u5341\u4efd\u6d89\u53ca\u8d22\u4ea7\u4fdd\u5b58\u4ee4\uff0c\u4e00\u4efd\u6d89\u53ca\u8bc1\u636e\u4fdd\u5b58\u4ee4\u3002&nbsp; \u5747\u5c5e\u4e8e\u5355\u65b9\u9762\u7533\u8bf7\u3002<\/li>\n<\/ul>\n\n\n\n<p>In addition to a collection of useful references\n(including the templates published by The Supreme People\u2019s Court of the PRC (\u201c<strong>SPC<\/strong>\u201d)\nfor use by the applicant or the qualified arbitration institutions), the HKIAC\nalso set out its own procedures and a list of required documents for the\nparties to apply for a letter of acceptance of the arbitration (the \u201c<strong>Letter<\/strong>\u201d)\nbefore and after the HKIAC accepts the arbitration.&nbsp; <\/p>\n\n\n\n<p>The Letter is required to be submitted to the relevant\nIntermediate People\u2019s Court (\u201c<strong>IPC<\/strong>\u201d) under Articles 3 and 4(4) of the\nArrangement for the purpose of the application.&nbsp; <\/p>\n\n\n\n<p>The key highlights of the HKIAC\u2019s procedures are:-<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>The application for the Letter itself is free of charge, but the HKIAC reserves its rights to charge for additional assistance under the Arrangement.<br><\/li>\n\n\n\n<li>The Letter will only be communicated to the applicant unless the applicant requests otherwise, and\/or to the IPC if requested by the IPC.<br><\/li>\n\n\n\n<li>The Letter may be submitted by the applicant to the IPC directly in accordance with the SPC\u2019s interpretation and application dated 26<sup>th<\/sup> September 2019.<\/li>\n<\/ol>\n\n\n\n<p>When applying for the Letter, the applicant must\nsubmit the following documents:-<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>A request for a Letter of Acceptance;<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>A copy of the application to the IPC including any supporting materials;<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>A copy of the IPC\u2019s decision on the application if it was made before\nthe HKIAC accepts the arbitration;<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>An indication as to whether any other party to the arbitration should be\ncopied on communications in relation to the request; and<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Any other documents or information required by the HKIAC.<\/li>\n<\/ul>\n\n\n\n<p>The main differences in relation to applications\nbefore and after the HKIAC accepts the arbitration are:-<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>Before the HKIAC accepts the arbitration, the applicant shall submit the application for interim measures to the relevant IPC directly.&nbsp; If the application is granted, the applicant must commence an arbitration at the HKIAC, and apply to the HKIAC for the Letter and submit the &nbsp;Letter to the IPC within 30 days.<br><\/li>\n\n\n\n<li>After the HKIAC accepts the arbitration, the application for interim measures shall be transferred by the HKIAC, or the applicant may submit such application together with the Letter to the IPC directly.&nbsp; <\/li>\n<\/ol>\n\n\n\n<p>Gall has, to date, assisted one client in making an\napplication for the Letter, and appreciates the HKIAC\u2019s efficiency and helpful\nguidance which smoothened the application process.&nbsp;
