{"id":8115,"date":"2019-12-23T00:49:00","date_gmt":"2019-12-22T16:49:00","guid":{"rendered":"https:\/\/www.gallhk.com\/maternity-leave-update\/"},"modified":"2026-03-10T13:08:42","modified_gmt":"2026-03-10T05:08:42","slug":"maternity-leave-update","status":"publish","type":"post","link":"https:\/\/www.gallhk.com\/cn\/maternity-leave-update\/","title":{"rendered":"\u4ea7\u5047\u76f8\u5173\u66f4\u65b0"},"content":{"rendered":"\n<p><img loading=\"lazy\" decoding=\"async\" width=\"30\" height=\"38\" class=\"wp-image-6207\" style=\"width: 30px;\" src=\"https:\/\/www.gallhk.com\/wp-content\/uploads\/2016\/12\/icon_pdf.jpg\" alt=\"\"> <a rel=\"noreferrer noopener\" aria-label=\" (opens in a new tab)\" href=\"https:\/\/gallhk.com\/Articles\/Employment_MaternityLeaveUpdateDec2019_cn.pdf\" target=\"_blank\">\u4e0b\u8f7d PDF<\/a><\/p>\n\n\n\n<p>\u52b3\u5de5\u53ca\u798f\u5229\u5c40\uff08<strong>\u201c\u52b3\u798f\u5c40\u201d<\/strong>\uff09\u6700\u8fd1\u516c\u5e03\u4e86\u5c06\u9999\u6e2f\u6cd5\u5b9a\u4ea7\u5047\u753110\u5468\u5ef6\u957f\u81f314\u5468\u7684\u76f8\u5173\u63aa\u65bd\u3002<\/p>\n\n\n\n<p>\u52b3\u798f\u5c40\u5c06\u4e8e 2019\u5e7412\u670827\u65e5\u5728\u516c\u62a5\u4e0a\u53d1\u5e03\u6709\u5173\u4ea7\u5047\u4fee\u8ba2\u76842019\u5e74\u96c7\u4f63(\u4fee\u6b63\u6848)\u6761\u4f8b\u6cd5\u6848<\/p>\n\n\n\n<p>\uff08<strong>\u201c\u6cd5\u6848\u201d<\/strong>\uff09\uff0c\u5e76\u4e8e 2020\u5e741\u67088\u65e5\u5c06\u6cd5\u6848\u63d0\u4ea4\u7acb\u6cd5\u59d4\u5458\u4f1a\u3002\u6b64\u4e3e\u76ee\u7684\u5c31\u662f\u5728 2021 \u5e74\u5e95\u4e4b\u524d\u5b9e\u65bd\u63d0\u51fa\u7684\u5404\u9879\u63aa\u65bd\u3002<\/p>\n\n\n\n<p>Whilst details of the Bill have not yet been made\npublic, the Bureau has previously in December 2018 set out in a Review of\nStatutory Maternity Leave (the \u201c<strong>Review<\/strong>\u201d) the proposals regarding the\nextension:-<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>The proposed\nextension of statutory maternity leave shall take effect in one go;<\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li>The rate of the\nmaternity leave pay for the additional 4 weeks shall be maintained at\nfour-fifths of the employee\u2019s average daily wages;<\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li>The Hong Kong Government\nshall bare the cost for the additional 4 weeks maternity leave pay. The\nemployer will pay the additional 4 weeks maternity leave pay and may then seek\nreimbursement from the Government subject to proof of payment;<\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li>The additional 4\nweeks maternity leave pay shall be subject to a cap of HK$36,822 per employee.<\/li><\/ul>\n\n\n\n<p>The Review further proposes 2 technical amendments to\nthe Employment Ordinance (Cap.57) (\u201c<strong>EO<\/strong>\u201d):<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>To update the\ndefinition of \u201cmiscarriage\u201d so that women who suffer miscarriage any time from\n24 weeks after conception shall be eligible for maternity leave.<\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li>To include a\ncertificate of attendance as being sufficient documentary proof for women to be\nentitled to sickness allowance for attending pre-natal examination (in contrast\nwith the current position which requires a medical certificate).<\/li><\/ul>\n\n\n\n<p>Employers are reminded that the other maternity\nprovisions under the EO shall continue to operate. The material provisions are\nas follows:-<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>Employees who intend\nto take maternity leave must give notice of her pregnancy to her employer and\nher intention to take maternity leave after her pregnancy is confirmed by a\nmedical certificate to be afforded the protections under the EO.<\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li>Maternity leave is\na statutory entitlement for female employee who is employed under a continuous\ncontract of employment immediately before taking any maternity leave.<\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li>To be eligible for\nmaternity leave pay, the pregnant employee has to be employed by the same\nemployer for at least 40 weeks immediately before the expected date of commencement\nof maternity leave.<\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li>An employer who\nfails to grant maternity leave and\/or maternity leave pay to an eligible\npregnant employee shall be liable upon conviction, a fine at HK$50,000.<\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li>An employer must\nnot terminate the employment of a pregnant employee under a continuous contract\nof employment after she has served a notice of pregnancy, until the date of\nexpiry of her maternity leave or the date of cessation of pregnancy. Any\ntermination of a pregnancy employee in the above circumstances will amount to\nan offence, the employer shall be liable upon conviction, a fine at HK$100,000.<\/li><\/ul>\n\n\n\n<p>Employees should be familiar with the rights and entitlements under the EO and its amended version once it becomes effective.
